Petitioner is directed to serve a copy of the revisional application upon Manoranjan Mahata, learned advocate who usually appears on behalf of the State. His appearance may be regularized by the concerned authorities in due course. Mr. Maiti, learned advocate appearing on behalf of the petitioner is aggrieved by the manner in which the trial is progressing.
It has been informed that the schedule of the trial is continuing. However, the witnesses are not turning up. The petitioner is in custody for a considerable period of time. Having regard to the manner in which the proceedings are progressing, I direct the learned special court to fix schedule consisting of three dates and fix such schedule on each and every month. No unnecessary adjournments may be granted to any of the parties.
The Deputy Commissioner of Police, in charge of New Town Police Station would be communicated by the learned special court for ensuring the appearance of the witness concerned on the date so fixed. In case after three dates being fixed, a witness do not appear, the learned special court will take a decision as to whether the evidence of the aforesaid witness is to be continued or to be closed. If the appearance of the witness cannot be traced, the concerned Deputy Commissioner of Police will submit a report before the court and the learned special court will accordingly take a decision.
The Public Prosecutor conducting the case would produce the materials, documents and exhibits on the dates so fixed. All stake-holders would cooperate with the learned trial court for concluding the trial at the earliest. With the aforesaid observations, the revisional application being CRR 4392 of 2023 is disposed of.
Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
