1. None appears on behalf of the parties.

2. This matter was initially adjourned in order to enable the learned counsel for the appellant to take appropriate instruction in the matter. The matter was adjourned on 22nd September, 2023, 3rd October, 2023. On 3rd October, 2023 it has been submitted on behalf of the appellant that the order of the Division Bench has already been implemented as an interim measure. On 14th December, 2023 the appellant was not represented. Accordingly, we fixed the matter on 18th December, 2023 with the direction that in the event the appellant is not represented on the adjourned date we presume that the appellant is not interested to proceed with the appeal.

We dispose of this appeal with the observation that the order of the Hon'ble Division Bench has already been implemented.

4. In view of disposal of the appeal, nothing remains to be decided in the application for stay being CAN 1 of 2022 and the same is accordingly disposed of.

5. However, there shall be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
