Learned advocate for the petitioner submits that the petitioner has been arrested on 1st November, 2025 and, since then, he is in custody.
Additionally, it has been submitted that there has been continuous transactions between the petitioner and the defacto-complainant for a period of three years. Learned advocate for the State, on the other hand, submits that there are overwhelming materials which reflect that the petitioner allured the defactocomplainant/informant.
However, learned advocate for the defactocomplainant/informant submits that there was non-payment of huge amount of money.
Be that as it may, since all the parties are of the opinion that there was continuous business transaction for a period of three years, I am of the view that further detention of the petitioner is unwarranted.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Sanchay Manna @ Sanchay Kumar Manna shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM-I, Kolkata.
If on bail, as the investigation is continuing, the petitioner shall meet with the investigating officer once in a week till the charge-sheet/report in final form is submitted before the learned jurisdictional court. The petitioner shall also not leave the jurisdiction of Kolkata Municipal Corporation without the leave of the learned ACJM-I, Kolkata.
Accordingly, CRM(R) 151 of 2025 is allowed.
