Versus

The State of West Bengal & Ors.

Mr. Avijit Saha ...for the petitioner Mr. Benazir Ahmed ...for the State Affidavit of service filed in Court today is taken on record.

The learned Advocate for the petitioner submits that the State respondents have been duly served. In spite of service, none appears on behalf of the State. Since none appears on behalf of the State respondents in spite of service, Mr. Benazir Ahmed, learned Advocate, who usually represents the State, is requested to appear in this matter.

Let the appointment of Mr. Ahmed, be regularized by the concerned authority.

Let a copy of the writ petition be served upon the junior of Mr. Ahmed in course of this day.

The petitioner states that a representation was submitted by the petitioner before the Collector on 11th January, 2008 stating the grounds of objection to the award. The learned Advocate appearing for the petitioner submits that no steps have been taken by the Collector to refer the matter for the determination of the Court. Heard the learned Advocate for the State.

Since the petitioner has filed an application under

Section 18 of the Land Acquisition Act, 1894, without entering into the merits of the claim made in the said representation, WPA 26462 of 2025 stands disposed of by directing the Collector, North 24 Parganas, being the second respondent herein, to consider the representation of the petitioner dated 11th January, 2008, which is annexed as annexure P-2 at page 12 of the writ petition, in accordance with law and to pass a reasoned order.

The reasoned order shall be communicated to the petitioner within a period of four weeks from the date of receipt of the server copy of this order along with copy of the representation, which has been annexed as annexure P-2 at page 12 of this writ petition.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
