This is an application for special leave to appeal challenging the judgment and order dated 30th September, 2023 passed by the learned Judicial Magistrate, 2nd Court, Durgapur, Paschim Bardhaman in connection with CR Case No.115 of 2013 (TR No.40 of 2013) acquitting the accused of the charge under Section 138 of the Negotiable Instruments Act.

Having heard the learned advocate on the ground of appeal and also having gone through the judgment impugned, I allow the instant application for special leave to appeal.

The appellant is at liberty to prefer an appeal within the statutory period.

With the aforesaid observation, CRMSPL 70 of 2023 stands disposed of.
