Petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly, learned advocate who usually appears on behalf of the State. His appearance may be regularized by the concerned Authorities in due course.

Mr. Majumder, learned advocate appearing for the petitioner submits that the petitioner was throughout on bail but because of his absence on 4th January, 2023, warrant of arrest was issued.

Learned advocate submits that the petitioner was earlier granted bail and although the case was initiated under Section 302 of the Indian Penal Code, but chargesheet was submitted under Section 304 of the Indian Penal Code.

Be that as it may, if the petitioner appears before the learned Additional Sessions Judge, Ranaghat, Nadia in connection with Sessions Case No. 6(1) of 2023 by 20th December, 2023, in that case the learned Sessions Judge would allow the petitioner to

continue on the same bail and bond after he is satisfied that the petitioner was earlier on bail. However, the learned Additional Sessions Judge would impose a condition that the petitioner till the stage of consideration of charges is over would meet with the Inspector-in-Charge or any officer deputed by him of Santipur Police Station once in every ten days. The concerned Officer would send a compliance report once in a month to the learned Additional Sessions Judge, Ranaghat, Nadia in connection with the Sessions Case No. 6(1)of 2023. In case the petitioner do not surrender on or before 20th December, 2023, the learned trial court would be at liberty to take steps in accordance with law under Section 82 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 4395 of 2023 is disposed of.
