Affidavit-of-service filed on behalf of the petitioner is taken on record.

State respondents are represented by learned advocates.

It is submitted by the learned advocate representing the petitioner that since Benches of West Bengal Administrative Tribunal are not available petitioner is compelled to file this writ petition in pursuit of remedy.

It is submitted that due to existing vacancies of posts of Chairman and Members of West Bengal Administrative Tribunal, said Tribunal is not functioning at present.

If Court proceeds on the premise that Benches in West Bengal Administrative Tribunal are not available this Court cannot assume jurisdiction.

Petitioner ought to have taken appropriate steps. 6.

At this juncture, learned advocate representing the petitioner prays for leave to withdraw the writ petition.

In view of the submissions made on behalf of the petitioner, writ petition stands dismissed as withdrawn.

8.

However, this order shall not preclude the petitioner to take steps in accordance with law by approaching the appropriate forum on selfsame cause of action.
