( Via Video Conference ) Re: An application for revision under Section 397 along with Section 482 of the Criminal Procedure Code.

And In Re : Sri Goutam Mitra. ...... petitioner. The subject matter of challenge of the revisional application relates to an execution case being preferred pursuant to an order of enhanced maintenance of Rs.3,000/- to the wife and Rs.1,000/- to each of the minor sons.

The present petitioner preferred a revisional application being Criminal Revision No. 50 of 2011 before the learned District and Sessions Judge, Jalpaiguri, subsequently the same was transferred to the Additional Sessions Judge, 4th Court, Jalpaiguri and the learned Sessions Judge was pleased to dismiss the revisional application. Records reflect that on 04.09.2014 the prayer for interim order was refused and there was a direction by a coordinate Bench to execute and enforce the order of maintenance along with the arrear.

Today when the matter has been taken up, none appraised this Court regarding the present stage of the proceeding. Having regard to the quantum of maintenance involved and the subject mater of the revisional application, I do not find any issue of fact or law for interference with the orders passed by the learned Courts below.

Accordingly, C.R.R. 2894 of 2014 is dismissed. All pending applications, if any, are disposed of.

Interim order, if any, is hereby vacated.

The Department is directed to communicate this order to the learned Court below within seven days from date. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
