1. Learned counsel for the petitioner confines his prayer to the extent that an appropriate direction may be issued for expeditious disposal of Chargesheet no. 391 of 2015 under Section 506 of the IPC and Section 4 / 8 of the POCSO Act arising out of Golabari Police Station Case no. 432 of 2014 dated 06.05.2014 pending before the learned Judge, Special Court under POCSO Act, Howrah as Special T R Case no. 53 of 2018. Learned counsel further submits that the petitioner no.1 is 78 years and the petitioner no.2 53 years of age and the case has not seen much progress.

2. The Court considers that no prejudice will be caused to either of the parties, if an appropriate direction is issued for the expeditious disposal. The fair and speedy trial is a facet of fundamental right.

3. In the facts and circumstances, learned Judge, Special Court under POCSO Act is directed to conduct the proceedings expeditiously in accordance with law preferably within a

period of one year without granting unnecessary adjournment.

4. Thus, present petition being CRR 5013 of 2025 stands disposed of.
