Petitioner submits allegation of abetment to suicide is unfounded. Co-accused have been granted anticipatory bail. Accordingly, he prays for similar relief.

Learned Advocate for the State opposes the prayer for anticipatory bail. He contends petitioner had made insinuations about the conduct of the victim over telephone. As a result, she committed suicide.

We have considered the materials on record. We have examined the statement of the maid Sabita Baidya. She alleged petitioner had made insinuations about the character of the victim over telephone. Out of depression she committed suicide. 4.

In light of the aforesaid materials, we note though petitioner made insinuations with regard to character, the same was not made in public view but over telephone. It is to be examined whether such insinuation per se would amount to abetment to suicide.

Under such circumstances, we are inclined to grant anticipatory bail to her.

Accordingly, we direct that in the event of arrest, the petitioner viz., Shilpi Mandal be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the BNSS. She shall appear before the jurisdictional court and pray for regular bail within four weeks from date. 7.
