The legal officer of the Bengal Police has submitted a report of the Officer-in-Charge, Santiniketan Police Station, Birbhum in the form of instructions addressed to the learned Government pleader.

It appears from the report that the private respondent No.6, Susmita Sarkar, daughter-in-law, indeed threatens, intimidates and uses abusive language against the writ petitioners. The petitioners feel intimidated and uncomfortable. In a complaint of attempt to kill the petitioners' son, Santiniketan Police registered a FIR and charge sheet being Santiniketan PS Charge Sheet No.78/2022 dated 29th May, 2022 has been filed under Sections 323/324 of the IPC. There is clear evidence before this Court that the private respondent No.6 is intimidating and causing discomfort to the writ petitioners. The writ petitioners are senior citizens and require the protection of law. The private respondent No.6 Susmita Sarkar shall not in any way visit or disturb the writ petitioners.

The Officer-in-Charge, Santiniketan Police Station, Birbhum shall strictly enforce this order. In the event of any further incident and/or complaint of the writ petitioners against the private respondent No.6, Santiniketan Police shall take coercive steps against the said private respondent No.6, Susmita Sarkar.

Santiniketan Police shall keep regular vigil over the writ petitioners' property.

The Officer-in-Charge, Santiniketan Police Station, Birbhum shall ensure that the said private respondent No.6 Susmita Sarkar is served with a copy of this order and sufficiently warn.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
