1. Learned counsel appearing for the petitioner submits as follows. The petitioner has been falsely implicated in this case. In any event, pursuant to the direction passed by the learned Magistrate, a part of the sum was returned to the de-facto complainant without prejudice.

2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. She relies on the case diary and refers to the statements of the victim and other witnesses. She submits that despite order being passed by the learned Magistrate, the remaining amounts directed to be paid were not paid.

3. Considering the materials available in the case diary and the fact that a part payment has been made without prejudice and the fact that charge-sheet has also been

submitted, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date.

5. The personal appearance of the Investigating Officer is noted and is dispensed with.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
