Begg ..for the State Learned counsel appearing on behalf of the petitioner submits that there is a case and counter case. In order to get out of the earlier case of theft, false allegations have been leveled against the petitioner in the present case.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. She relies on the statements of the victim recorded before the learned Magistrate and the statements of an eye-witness. In both the statements, the petitioner's name has been categorically taken as one of the miscreants. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
