Records reveal that the writ petition was preferred by the writ petitioner/respondent no.1 herein praying for issuance of necessary direction upon the respondents to consider the candidature of the writ petitioner for recruitment to the post of Office Executive under the appellant no. 1. Upon contested hearing, the writ petition was disposed of directing inter alia that the candidature of the writ petitioner for the concerned post has to be considered within a period of four weeks from the date of the order upon compliance of all necessary formalities and if the writ petitioner is found to be otherwise eligible, he shall be appointed within four weeks from date. Aggrieved by the said order, the present appeal has been preferred by the respondent nos.1 to 4/appellants herein. In course of hearing, Mr. Ghosh, learned advocate appearing for the writ petitioner/respondent no.1

submits, upon instruction, that the writ petitioner has abandoned his claim and undertakes that he would take all necessary steps to withdraw the contempt application which has already been filed by him. Let the written instruction, as produced, be kept on record.

In view thereof, no further interference is called for in the present appeal and the same along with the connected application is disposed of.

It is, however, made clear the order impugned in the present appeal shall not be treated as a precedent. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
