Rakib (Rejected) CRM (M) 2436 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj Police Station Case No. 266 of 2021 dated 16.05.2021 under Sections 302/201/34 of the Indian Penal Code. Learned advocate appearing for the petitioners submits that the petitioners are in custody for four years six months and only 24 witnesses out of the proposed 32 witnesses have been examined till date and on any stringent conditions learned advocate prays for bail on behalf of the petitioners. Learned advocate for the State submits that they intend to examine all the witnesses and eight more witnesses are left to be examined.

Since custodial trial is in progress, as a matter of last opportunity prosecution is granted time till 31st of March, 2026 to conclude the prosecution evidence.

In case the prosecution is unable to complete the prosecution evidence by 31st of March, 2026 the learned trial

Court will release the petitioners on bail on such terms and conditions as he deems fit and proper.

As such, CRM (M) 2436 of 2025 is dismissed at this stage.

No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of the resolution of the local bar.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
