171. Anand Kumar Roongta BD. Vs. Balai Chandra Das Mr. Tarak Nath Halder Mr. Sayan Mukherjee ... for the opposite party. The instant application has been preferred challenging the order of the Appellate Court passed in Ejectment Appeal No. 20 of 2024 by which the learned Appellate Court granted stay of the execution proceeding till disposal of the appeal on condition that the appellant would go on paying the occupational charges @ Rs. 30,000/- per month and also giving liberty to pay the arrear occupational charges by five equal monthly instalments.

Mr. Halder, learned counsel appearing on behalf of the opposite party submits that during pendency of the instant application the aforesaid appeal being Ejectment Appeal No. 20 of 2024 has already been dismissed on contest vide Judgment dated 20.09.2025.

In such view of the matter, the instant application is dismissed being infructuous. Copy of judgment dated 20.09.2025 is taken on record. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
