The petitioners allege that their water connection has been disconnected by the private respondents who are co-sharers in respect of the property in question. The petitioners are deprived of getting water in the premises since the water pipeline has been damaged by the private respondents. The petitioners seek implementation of the order of status quo granted by the learned civil Court in a civil suit pending between the parties and also for repairing of the water pipeline and restoration of the water supply to the premises. It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioners prosecution has been submitted under Section 126 of the BNSS.
Since the learned civil Court has granted an order of status quo upon the parties in respect of the nature, character and possession of the property in question, the petitioners are at liberty to approach the said learned Court for implementation of the said order with police assistance.
Learned counsel for the petitioners submits that there is no water connection in their premises at present. They seek to apply for a fresh water connection therein. They are at liberty to do so.
In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident and shall ensure maintenance of peace and tranquility.
The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
