After some submission, learned counsel for the petitioner submits that he may be given liberty to withdraw the present petition and challenged the order dated 11th September, 2025 of learned ACJM, Barrackpore whereby directions were issued under Section 175(3) of the BNSS, 2023. Learned counsel submits that earlier on the similar allegations, the opposite party/de facto complainant got registered a case No.79 of 2025 Barrackpore Women Police Station and then filed the private complaint.

Liberty granted.

Petition is dismissed as withdrawn. However, it is made clear that no expression made herein shall tantamount to be an expression on the merit of the case.
