In the matter of : An application under Section 482 of the Code of Criminal Procedure.

The present revisional application has been preferred against the order dated 23rd July, 2013 passed by the learned Judicial Magistrate, 1st Court, Sealdah in Miscellaneous Case No. 124 of 2012 (T. R. No. 356 of 2012) under Section 125 of the Code of Criminal Procedure. By the said order, the learned Magistrate was pleased to award Rs.5000/- to the wife as interim maintenance. Records of the revisional application reflect that on 24th December, 2013, a co-ordinate Bench of this Court was pleased to direct the husband to pay a sum of Rs.4500/- by way of interim maintenance during the pendency of the revisional application.

Having regard to the fact that the said order has been passed more than 7 years ago and the quantum of Rs.4500/-

is substantial for maintenance by way of interim measure, I am of the view that the interim order so passed should be made absolute.

Accordingly, the order dated 23rd July, 2013 so passed by the learned Judicial Magistrate, 1st court, Sealdah is modified to the extent that the interim maintenance is to be paid in the mode and manner to the tune of Rs.4500/- per month.

With the aforesaid observations, the present revisional application being CRR 3046 of 2013 is dismissed. All pending applications, if any, are consequently disposed of.
