Jamini Kumar Sarkar v. State Of West Bengal & ORS
04.08.2021 Ct. No. 8 sdas W.P.A 25917 of 2018 with CAN 1 of 2020 with CAN 2 of 2020 Jamini Kumar Sarkar Vs.
The State of West Bengal & Ors.
Mr. Arun Shaw .... for the petitioner Ms. Chama Mookherji Ms. Monika Pandit .... for the State An order rejecting an application for grant of new gun licence is under challenge in this writ petition.
It appears that the petitioner applied for a gun licence which was considered by the authorities. The same was rejected by an order dated June 12, 2018 which is impugned in the present writ petition. The impugned order contains reasons as to why the application for gun licence was rejected. It specifies that the applicant was an unemployed youth with threat to his life. Moreover, the house of the applicant was not secured.
It is not for the writ court to act as the appellate authority and reappraise the evidence and
come to a different finding with that of the impugned order. The impugned order is reasoned.
In such circumstances, I find no reason to interfere with the impugned order.
Accordingly, the writ petition being WPA No.
25917 of 2018 is dismissed without any order as to costs.
In view of dismissal of the writ petition, the connected applications being CAN 1 of 2020 and CAN 2 of 2020 are also dismissed.
