Kausik (Allowed) CRM (NDPS) 1494 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jalangi Police Station Case No. 184 of 2023 dated 07.06.2023 under Section 186/188 of the Indian Penal Code, 1860 and under Section 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 5 months, charge sheet has been submitted. Charge has also been framed by the learned Trial Court. The other accused persons who fled away from the spot according to the petitioner has been granted bail. Learned advocate for the State submits that the petitioner was arrested and was absconding for a considerable period of time.

Having considered that charge has already been framed and the prosecution has relied upon 9 witnesses to prove its case and there is no possibility of the trial being completed in near future, I direct to release the petitioner on bail.

As such the prayer for bail of the petitioner is allowed. Petitioner, namely Ajijul Mondal @ Azizul Biswas, shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act cum Additional Sessions Judge, 5th Court at Berhampore, Murshidabad.

If on bail the petitioner shall not leave the jurisdiction of the District of Murshidabad and shall be physically present on each and every date fixed by the learned Trial Court. In the alternative, the learned Trial Court would cancel the bail of the petitioner without further reference to this Court. Accordingly, CRM (NDPS) 1494 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
