Earlier, a report was submitted before this court, which reflects that the police authorities could not forward the recommendation, as NOC was not obtained from the Panchayat Samity.

However, such application has been forwarded and the communication of the Chopra Panchayat Samity to the petitioner reflects that they have certain issues till 3.00 pm and, regarding the sound system to be operated over there.

The police authorities are directed to give permission to the petitioner and the petitioner undertakes that they would organize the programme at the hall which has been specified in the writ petition from 3.30 pm to 6.30 pm.

So far as the sound system is concerned, the petitioner and the organizer conducting the programme would abide by the decibel level permitted by the West Bengal Pollution Control Board.

Adequate police force be deputed to control the law and order situation. If there are further issues, which requires continuation of the programme as also any crisis arising in course and after the programme, the local administration i.e., the SDO and/or BDO would exercise their discretion in tackling such situation.

With the aforesaid observations, WPA 26892 of 2024 is disposed of.

Documents submitted by the learned advocate for the petitioner as well as the State be kept with the record.
