Kausik (Rejected) CRM (NDPS) 1495 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sagarpara Police Station Case No. 474 of 2024 dated 28.11.2024 under Section 21(C)/29 of the NDPS Act, 1985;

Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh ......for the Petitioner.

Mr. Saryati Dutta Mr. Subhajit Chowdhury ......for the State.

Petitioner surrendered before the learned Special Court on or about 03.11.2025 and thereafter he has been taken into custody.

Learned advocate submits that earlier the anticipatory bail of the petitioner was rejected.

The subject matter of the case relates to recovery of 741 bottles of Phensedyl.

Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner.

Be that as it may, since the charge has not been framed and the petitioner has only surrendered on 03.11.2025 and the

case was registered on November, 2024 I am not inclined to release the petitioner on bail at this stage. Petitioner is directed to renew his prayer for bail after the stage of consideration of charges are over. Accordingly, CRM (NDPS) 1495 of 2025 is dismissed at this stage.
