1. Petitioners renew their prayer for bail.

2. Learned appearing for the petitioners submits that, petitioners are in custody in excess of three years. Out of 21 prosecution witnesses, 8 were examined.

3. Learned advocate appearing for the State submits that, three persons received injuries in an incident of assault. One expired. All three injured named the petitioner no.1 as one of the assailants. She points out that, two of the other assailants named in the injury reports are still absconding. Out of the women folk who were granted bail by the coordinate Bench, some are absconding.

4. Prayer for bail before us were rejected at least thrice for the petitioner nos.2 and 3. Prayer for bail of the petitioner No.1 was rejected four times prior to this application.

5. All petitioners before us stand implicated in the assault of the victim resulting in his death.

6. Trial is in progress. Out of 21 prosecution witnesses, 8 were examined.

7. Considering the gravity of the offence and involvement of the petitioners therein, and the period of detention and the fact that, the trial is in progress, we are not inclined to grant bail to the petitioners.

8. Prayer for bail of the petitioners is rejected.

9. CRM(DB) 3784 of 2024 is dismissed.
