Petitioner is directed to serve a copy of the revisional application upon Mr. Mirza Firoj Ahmed Begg, learned advocate who usually appears on behalf of the State. His appearance may be regularized by the concerned Authorities in due course. Mr. Karmakar, learned advocate appearing for the petitioner submits that the petitioner was unaware regarding the pendency of the present case and Investigation Agency has already submitted chargesheet before the jurisdictional court pursuant to which warrant of arrest has been issued against the present petitioner.

It has been submitted that the learned Magistrate in respect of similarly placed accused persons have assigned his reasons for releasing them in bail.

Be that as it may, the petitioner undertakes to surrender by 20th December, 2023. In case, the petitioner surrenders before the jurisdictional Magistrate and prays for bail, the learned

jurisdictional court/learned Magistrate would take the complicity of the present petitioner and the parity with other accused persons who have been released on bail and thereafter dispose of the application for bail in accordance with law. In case the petitioner do not surrender within the schedule time period i.e. by 20th December, 2023, the learned jurisdictional court will revive the executing the warrant of arrest which is pending. For the time being, the execution of the warrant of arrest so issued be stayed till 20th December, 2023.

With the aforesaid observations, the revisional application being CRR 4406 of 2023 is disposed of.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
