The petitioner complains that Maheshtala Municipality has not taken steps for consideration of the plan proposal filed before the Municipality along with the requisite fees in February 2022.

The petitioner thereafter made representation before the Chairman of the Municipality with a request to consider the plan proposal. The same is yet to be considered.

None appears on behalf of the Municipality despite service.

Affidavit-of-service filed in Court today is taken on record.

As it appears that the plan proposal is pending consideration before the Maheshtala Municipality, accordingly, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the respondent no. 2 being the Mahestala Municipality to consider the plan proposal submitted by the petitioner in accordance with law, at the earliest, but positively within February 10, after giving reasonable opportunity of hearing to the petitioner and to intimate the fate of the plan proposal to the petitioner immediately thereafter.

The writ petition stands disposed of.
