Petitioners are driver and his helper who have approached this Court after being detained for approximately 1 year. The subject matter of the case relates to recovery of 103 Kgs. of Ganja.

Learned advocate submits that the present petitioners are innocent and they have been falsely implicated in connection with the instant case and on any stringent condition they may be released on bail.

Learned advocate for the State submits that the petitioners are thickly connected with the offence and in respect of another accused anticipatory bail has been rejected and the said accused is still fleeing away from the process of law.

Having considered the quantum of recovery in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. As such the prayer for bail of the petitioners are rejected.

Accordingly, CRM (NDPS) 1497 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
