At the time of call no one appears for the petitioners and no accommodation is prayed for. On perusal of the writ petition, it appears that petitioners have prayed for issuance of mutation certificate as well as sanction of building plan by the respondent nos.5 & 7.
Having perused the scope of the writ petition it appears that it should have been classified as Group-V (Municipality) matter.
However in the presentation form it has been wrongly classified as Group-IX (Residuary) matter. However, Bidhannagar Municipal Corporation is represented by learned advocates. The writ petition was called on for consideration on 16th June, 2023 when no one appeared for the petitioners.
It appears that petitioners have lost interest.
The writ petition stands dismissed.
Interim order, if any, stands vacated.
Department is directed to correct the presentation form by classifying the writ petition as Group-V matter.
Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
