Rakib (Rejected) CRM (NDPS) 1498 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Patiram Police Station Case No. 307 of 2024 dated 03.12.2024 under Sections 21(C)/22C/23C/27A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 11.09.2025. The subject matter of the case relates to 397 bottles of phensidyl. It has further been emphasized that there has been no recovery from the petitioner, as such on any stringent condition the petitioner may be released on bail.

Learned advocate for the State on the other hand opposes the prayer for bail and draws the attention of the Court to the order of rejection of anticipatory bail of the petitioner in CRM (A) 2459 of 2025.

Although, there were no recoveries but some connection has been established between the petitioner and the other accused persons.

Be that as it may, the case is of December, 2024, charge-sheet has been submitted and the charges are yet to be framed. Having regard to the stage of the case, at this stage, I am not inclined to release the petitioner on bail. Petitioner is directed to renew the prayer for bail after the stage of consideration of charges is over. Accordingly, CRM (NDPS) 1498 of 2025 is rejected at this stage.
