Ct. 238 Mr. Kishore Datta, Ms. Sumita Shaw, Mr. Nilendu Bhattacharya ...for the Petitioner Mr. Kallol Basu, Mr. Amitabrata Roy, Mr. Arkadipta Sengupta ...for the University When this writ petition was taken up for hearing on November 2, 2023, a co-ordinate Bench of this Court, inter alia, directed the university to decide the question of affiliation of the petitioner-college by November 3, 2023. Today, a report has been filed by the university. The petitioner has also taken an exception to the report by way of an affidavit.

Let the exception filed by the petitioner be kept with the records.

It, however, appears that the university has not yet been taken any decision with regard to the affiliation of the college, though in the report, certain deficiencies have been pointed out. Mr. Datta submits that his college will file an undertaking before the university to cure the deficiencies.

I am not inclined to decide the issue of affiliation at the first instance as the same should be decided by the university.

The petitioner will be at liberty to furnish an undertaking before the university within one-week from date. The university shall decide the question of affiliation after taking into consideration the undertaking within one-week thereafter and communicate the decision to the petitioner immediately.

WPA 25791 of 2023 is disposed of.
