Learned counsel for the petitioner alleges that although a provisional order of assessment was passed against the petitioner, neither any hearing on the same has been given to the petitioner subsequently, nor has any final order of assessment been passed.

It is submitted that the petitioner gave several representations in that regard, but to no effect. Learned counsel appearing for the WBSEDCL submits that due to transfer of the Station Manager concerned, there was some internal delay in the matter. However, it is candidly submitted that the WBSEDCL authorities shall decide on the issue as expeditiously as possible.

In view of such a fair approach having been taken by the WBSEDCL, WPA 26630 of 2022 is disposed of by directing the WBSEDCL to fix a date for hearing on the provisional assessment order and, upon hearing the

petitioner on the same, to pass a final order of assessment at the earliest.

Keeping in view the delay already occasioned, the entire process, it is expected, shall be completed within two working weeks from today.

The merits of the allegations and counter-allegations of the parties have not been gone into by this court. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
