The respondent/ distribution company is represented and submits that there are serious dispute in respect of the title of the premises. In fact, it is submitted by the Advocate appearing on behalf of the respondent/ distribution company that the premises in which the petitioner seeks an electricity connection has vested in the State and the same has been given to the West Bengal State Distribution Company Limited (in short, "WBSEDCL").

The submission of the Advocate appearing on behalf of the WBSEDCL is disputed by the Advocate appearing on behalf of the petitioner.

In view of the dispute which arises for consideration I direct the issues raised in this writ petition be decided by the concerned District Magistrate within a period of eight weeks from date and after giving opportunity of hearing to the petitioner and all other affected parties.

The petitioner is granted liberty to file a representation before the District Magistrate within a week from today.

The concerned District Magistrate is requested to give a right of hearing to the petitioner and all other effected parties before taking any final decision. With the aforesaid decisions WPA No. 24148 of 2019 stands disposed of.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
