This is an application wherein petitioner has prayed for a direction upon the court below for expeditious disposal of L.A. Case No. 57 of 2021 (CIS of 2021) presently pending before Additional District Judge, 1st Court at Asansol. Petitioner submits that the matter is pending since long and a direction may be passed upon the court below accordingly.

Since the prayer made on behalf of the petitioner is innocuous and if any order is passed in terms of aforesaid prayer made by the petitioner, neither parties will have a cause to prejudice, the service of copy of application along with notice upon the opposite party is dispensed with.

Having heard learned counsel appearing on behalf of the petitioner and that the prayer made in

the application is justified, C.O. 3893 of 2024 is hereby disposed of with a direction upon the court below in making every endeavour for expeditious disposal of the L.A. Case No. 57 of 2021 (CIS 54 of 2021) without granting any unnecessary adjournment to either side and also taking aid from Order 17 of the Code of Civil Procedure. The learned trial court shall make his best effort to conclude the entire proceeding preferably within a period of three months from the date of communication of this order.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
