The petitioner is aggrieved that notwithstanding an order passed by the learned Civil Judge (Junior Division), 2nd Court, Barasat, North 24 Parganas dated 1st October 2018, the Officer-in-Charge, Habra Police Station has not rendered assistance.

Counsel for the State submits that his client has not received any intimation from the petitioner that the defendants in the suit are, in fact, violating the order of injunction or that the interim order of injunction is still continuing.

In these circumstances, the writ petition is disposed of directing the Officer-in-Charge, Habra Police Station, to render assistance to the petitioner, on first being informed that the interim order of injunction is still pending and continuing, and also that the defendants are, in fact, disturbing his peaceful possession. It is expected that after being satisfied, the

Officer-in-Charge, Habra Police Station, shall take prompt and immediate steps.

In view of the disposal of the writ petition, connected applications, if any, shall also stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
