Mr. Trivedi, learned Counsel appearing on behalf of the respondents has also made his submission. Upon a suggestion made by this Court, Mr. Shraff has agreed to withdraw this writ petition with liberty to file appeal.

In view of the above, this writ petition is dismissed as withdrawn with liberty to the petitioner to file appeal in accordance with law.

I make it clear that the point of limitation is not to be taken as point for disbarring them.

Appellate authority is directed to hear the matter on all grounds available to the writ petitioner including the point of principles of natural justice.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
