This is an application for a direction upon the Trial Court for expeditious disposal of Gaighata Police Station Case No. 158/2022 dated 21st February, 2022 under Section 21(C) of the NDPS Act and Section 14 of the Foreigners Act corresponding to N. Case No. 27/2022 pending before the learned Additional Sessions Judge, 6th Court at Barasat. It is submitted on behalf of the petitioner that the petitioner was arrested in connection with the above-mentioned case on 21st February, 2022.

Subsequently charge-sheet and supplementary charge-sheet has been filed in the Trial Court and only on 16th September, 2022 the date was fixed for consideration of charge. On that date charge against the accused person was framed by the Trial Court and 19th December, 2022 to 21st December, 2022 was fixed for recording evidence of the witnesses. However, no

witness was present. Therefore, another date has been fixed by the learned Trial Judge.

On perusal of the order-sheet, I do not find any delay committed by the learned Trial Judge in proceeding with the trial of the aforesaid case. In view of such circumstances, at this stage no direction upon the Trial Judge for expeditious disposal of the case is warranted. The application is, accordingly, dismissed summarily.
