Mr. Saibal Acharyya, Mr. Pradip Paul ...for the petitioner Mr. Biswabrata Basu Mallick, Ms. Rajlakshmi Ghatak ...for the State The petitioner complains of alleged inaction on the part of the Sabang Police Station. It is submitted that the petitioner has been wrongfully deprived of a water tap connection in his house from a common submersible pump installed by the local administration under MPLADS fund.

The Officer-in-Charge, Sabang Police Station has made an enquiry and submitted instructions addressed to the learned Government Pleader dated 15.11.2022. It appears that the distance between the residence of the petitioner and the submersible pump is about 500 meters and the pump did not have the capacity to push water that far.

This is denied by the counsel for the petitioner. It is submitted that lot of persons near the petitioner's

home, are getting water supply and he is being denied the same for belonging to rival political party. This Court is of the view that the police have no role to play in the matter. The petitioner may take up the grievance of non-supply of water before the appropriate bench in a separate proceeding.

With the aforesaid observations, the instant writ petition shall stand disposed of.

The instructions of the Officer-in-Charge, Sabang Police Station addressed to the learned Government Pleader dated 15.11.2022 are kept with the record.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
