Mr. Krishnendu Bera Ms. Mithu Das ...for the petitioner Mr. Gourav Das ...for the respondent no.3 Mr. Suranjan Das Gupta ...for Maulana Abul Kalam Azad University of Technology The petitioner is a student of Bachelor of Computer Application at a College namely, Guru Nanak Institute of Technology, Kolkata under Maulana Abul Kalam Azad University of Technology. The petitioner has successfully completed his first and second semesters of the said course.

It has been submitted on behalf of the petitioner that due to the illness of one of the family members, the petitioner could not arrange for the necessary fees for the third semester examination and as such, he could not deposit the same before the University within the stipulated time. The last date for submission of fees was November 21, 2022.

Since the petitioner could not deposit the fees, he was not allowed to take part in the internal practical examination conducted by the relevant College on

November 24, 2022. Tomorrow is the date of commencement of the theory examinations. The petitioner naturally, has not been allowed to take part in the said theory examinations also.

It has been submitted by the learned advocate for the petitioner that the petitioner has arranged for the fees and he is ready and willing to deposit the same in course of this day.

Keeping in mind the future of the student, I am inclined to allow such prayer. The petitioner is permitted to deposit his fees by 4.30 p.m. today before the University. Upon production of proof of such deposit, the College will allow him to take part in theory paper examinations of the third semester. The College may issue the admit card subsequently. As a special case, the College will hold a separate practical examination for the petitioner for the said semester. I make it clear that this order has been passed purely on humanitarian ground and this order will not create any precedent.

Accordingly, WPA 26645 of 2022 is disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
