Rakib (Rejected) CRM (NDPS) 1501 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Entally PS/DD Case No. 270 of 2023 dated 14.09.2023 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that from the joint possession of the petitioner and another 64 kgs. of ganja were recovered and in spite of direction there has no progress in the case and only three witnesses have been examined out of the proposed eight witnesses charge-sheeted by the prosecution.

Learned advocate for the State submits that efforts are being put in by the prosecution to conclude the trial. Be that as it may, prosecution is directed to conclude the examination of rest of the witnesses by 15th of May, 2026. Petitioner would renew his prayer for bail, in case within the aforesaid period the examination of the prosecution witnesses are not over.

No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of the resolution of the local bar.

In view of the aforesaid observations CRM (NDPS) 1501 of 2025 is rejected at this stage.

Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
