It is pointed out by learned counsel for the petitioner that the joint inquiry is already complete and the extracted list from the detailed joint survey/report containing the list of beneficiaries has been forwarded by the BL & LRO, Kandi, Murshidabad to the SDL & LRO, Kandi, Murshidabad on 25.11.2010. Thereafter, no action has been taken.

It is pointed out by learned counsel for the State that the appropriate action is to be taken by the respondent no. 4, ADM-cum-DL & LRO, Murshidabad but the list has not been forwarded to him.

Hence, we direct the SDL & LRO, Kandi, Murshidabad to forward the list dated 25.11.2010, sent

by BL & LRO, Kandi, Murshidabad, to the respondent no. 4, ADM-cum-DL & LRO, Murshidabad without any delay. On receiving the list, respondent no. 4 will take an appropriate decision in accordance with law expeditiously, preferably within a period of three months from the date of receipt of the list.

The petition is accordingly dismissed.
