Learned counsel for the petitioners submits that the petitioners do not want to proceed any further with the writ petition.

It is also submitted that the respondent no.1 be directed to return the earnest money deposited by the petitioners.

Learned counsel appearing for the respondent no.1 submits that the said respondent has not yet encashed the demand draft handed over by the petitioners by way of earnest money and as soon as the petitioners or their representatives approach the respondent no.1's office, the same would be returned to the petitioners.

WPA 25689 of 2016 is disposed of as withdrawn in the light of the above observations.

The respondent no.1 shall, when so approached by the petitioners, return the demand draft deposited previously by the petitioners with the respondent no.1 by way of earnest money immediately upon such approach being made.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
