Affidavit-of-service filed on behalf of the petitioner is taken on record.
The learned advocate representing the petitioner submits that her mother was an Assistant Teacher in a Government aided Secondary School who died-in-harness on 27th November, 2022.
It is also submitted that after death of mother of the petitioner application was made within time for petitioner's appointment on compassionate ground and on demand relevant documents have been submitted by the petitioner before the District Inspector of Schools (SE), Kolkata being respondent no.3 for taking necessary steps.
The grievance of the petitioner is till date in spite of submitting relevant documents as sought
for no decision has been taken by the respondent no.3.
State respondents are represented by learned Additional Government Pleader who submits that since application for appointment on compassionate ground is pending before the respondent no.3, let direction be given upon the respondent no.3 to take decision in accordance with law.
Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing the District Inspector of Schools (SE), Kolkata to decide the application of the petitioner made for appointment on compassionate ground by six weeks from the date of communication of this order and the decision to be taken by the respondent no.3. shall be forwarded to the petitioner within one week thereafter.
It is further clarified that if decision is taken in farour of the petitioner for appointment on compassionate ground the recommendation shall be made to the concerned authority of the West Bengal Central School Service Commission for taking further steps.
However, there shall be no order as to
costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
