The petitioner prays for expeditious disposal of the Miscellaneous Case No.02 of 2019 arising out of Matrimonial Suit No.18 of 2021, which is pending before the learned Additional District Judge, 2nd Court, Sealdah, South 24-Parganas. It is submitted that the Misc case is at the stage of argument.

The prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the party. Hence, there is no requirement for service of prior notice upon the opposite party.

This revisional application is disposed of by requesting the learned Additional District Judge, 2nd Court, Sealdah, South 24-Parganas to dispose of the Miscellaneous Case No.02 of 2019 arising out of Matrimonial Suit No.18 of 2021 upon giving adequate opportunity to all the contesting

parties, but without granting any unnecessary adjournment to either of the parties, strictly in accordance with law, preferably within a period of two months from the date of communication of this order.

This court has not expressed any opinion on the merits of the Misc case. The learned court shall proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite party and/or the learned advocate contesting the matter on behalf of the opposite party in the learned court below, within a week. 6.

Affidavit-of-service to be filed before the Court below.

The revisional application is accordingly disposed of. There shall be no order as to costs.
