1. Report filed on behalf of the State of West Bengal upon obtaining instruction from the State of Tamil Nadu is taken on record.

2. Learned counsel appearing on behalf of the petitioner submits as follows. The allegations are purely civil in nature. In spite of that an FIR has been registered by the concerned police station and ante-dated notice under Section 35(3) of the BNSS is being pursued continuously in this regard.

3. Learned counsel appearing for the State, upon instructions from the concerned police station of the State of Tamil Nadu, opposes the prayer for transit anticipatory bail. She submits that the petitioner had cheated the de-facto complainant by charging Rs.3 Lakhs for an article which was worth Rs.80 thousands.

4. Considering the above, let the petitioner not be arrested in connection with the instant case for eight weeks from date. Within such time, the petitioner shall be at liberty to pray for appropriate relief before the Courts in the State of Tamil Nadu including filing an application for anticipatory bail.

5. With the aforesaid observations, the application for transit anticipatory bail is disposed of.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
