1. Leave is granted to amend the cause title.

2. Report filed on behalf of the State is taken on record.

3. Learned counsel appearing for the petitioner submits that other than the statements of the co-accused, there are no other incriminating materials available against the present petitioner.

4. Learned counsel appearing for the State relies on the case diary and the report and opposes the prayer for anticipatory bail. He submits that as per the report there were frequent phone calls between the petitioner and the other co-accused at the relevant time.

5. Considering the above and the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

6. Accordingly, the application for anticipatory bail is rejected.
