Court no. 8 Sd/br In the High Court at Calcutta Criminal Miscellaneous Jurisdiction Appellate Side CRM (NDPS) 1790 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure filed on 26.10.2023 in connection with Hingalganj Police Station Case No. 19 of 2022 dated 06.02.2022 under Sections 20(b)/29 of the NDPS Act, 1985 and Section 14/14(c) of the Foreigners Act.

Heard learned counsel for the parties.

The allegation against the petitioner is that intermediate quantity of ganja below the commercial quantity was recovered from the petitioner.

That apart, a co-accused person standing in similar footing as the petitioner was released on bail by an order dated June 15, 2022. Hence, on the ground of parity, the petitioner is also entitled to bail.

4. Accordingly, CRM (NDPS) 1790 of 2023 is allowed, thereby granting bail to the petitioner on condition that the petitioner shall furnish bond of Rs. 10,000/- (Rupees Ten

Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24 Parganas.

5. Moreover, the petitioner shall not leave the territorial jurisdiction of the Trial Court without the leave of the jurisdictional court during the entire period of trial and shall attend each and every date of trial.

That apart, the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing such facts to any police officer or the court and not tamper with evidence in any manner whatsoever.
