Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the fact that in spite of orders being passed in Title Suit No. 227 of 2024, the police authorities have failed to comply with the order passed by learned Civil Judge (Junior Division), 1st Court, Durgapur on 16.08.2024.
State has submitted a report which reflects that the police authorities have already sent their report to the court of the learned Civil Judge (Junior Division), 1st Court, Durgapur. To that effect, photostat copy of the report along with photostat copy of receiving seal of the concerned court has been enclosed. The report so submitted before this Court is restricted to two documents which have been enclosed. The petitioner claims that she is unable to enter the residence. However,
since the police authorities have sought for also information from the Manager of the concerned colliery, I am of the opinion that further orders, if any, should be passed by the civil court which is in seisin of the matter. Accordingly, State is directed to hand over a copy of the report along with all annexures to the learned advocate appearing for the petitioner.
The petitioner would take appropriate steps before the learned Civil Judge (Junior Division), 1st Court, Durgapur in accordance with law.
With the aforesaid observations, the writ petition being WPA 27000 of 2024 is disposed of. There shall be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
