Mr. Kaushik Chatterjee, learned advocate appearing for the petitioner submits that during the pendency of the revisional application he has instruction that the petitioner has expired and as such, the subject matter of the revisional application, according to him, has become infructuous.
Mr. Ganguly, learned advocate appears on behalf of the State. The subject matter of the revisional application relates to an order of conviction and sentence passed by the learned Assistant Sessions Judge, which was affirmed by the learned appellate court being the learned Additional Sessions Judge, 1st Court, Suri, Birbhum in Criminal Appeal No. 07 of 2006. In view of the prayers so advanced by the petitioner, I am of the opinion that the revisional application be dismissed as infructuous. Pending applications, if any, are consequently disposed of.
