Mr. Bhaskar Manna ..for the Petitioners ...for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. Heard learned counsels for the parties.
Learned counsel for the petitioners submits that the title in respect of the land in question has been decided in favour of their father by a civil court. The private respondents who are rank outsiders are disturbing their peaceful possession in the said land and are obstructing them from cultivating the same. The petitioners seek police assistance.
Learned counsel for the State submits that pursuant to a complaint lodged by the petitioners, enquiry was held and prosecution submitted under Section 126 of the BNSS.
Since the petitioners allege that the private respondents are disturbing their peaceful possession in the land in question and obstructing them from
cultivating the same, they are at liberty to approach the appropriate civil forum for redressal of their grievance. In the meantime, the police authority shall keep strict vigil over the area in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility.
The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
