In terms of the direction dated February 03, 2023 Ms. Bhattacharyya, learned Counsel for the West Bengal Board of Secondary Education files the report of the Board, let it be kept with the record.

The petitioner appeared in the Madhymik Examination, 2022 and successfully passed the said examination with outstanding grade.

The Regulation 14 of the West Bengal Board of Secondary Examination Regulation 2001 since does not permit reassessment of the answer script of a successful student, the prayer of the petitioner for such reassessment of her English and Bengali answer scripts has already been refused by this Court vide order dated February 03, 2023.

However, by the said order, the Board was directed to re-calculate the number awarded to the petitioner against her answer to the

Question No. 1A(a) and (b) under Section-A of English (Second Language) paper.

It appears from the aforementioned report of the Board that the petitioner is entitled to 2 (two) additional marks in the English language paper against her answer to the aforementioned questions.

The Board, therefore, after adding the said 2(two) marks shall issue a new mark-sheet to the petitioner and for the aforesaid purpose she will approach the Board within a week from date.

W.P.A. 26685 of 2022 is disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
